1. Agreement to These Terms

These Terms & Conditions ("Terms") are a legally binding agreement between you and 60 Yard ("Company", "we", "us", or "our") regarding your access to and use of our website, Android application, iOS application, APIs, and related real estate services (collectively, the "Services").

By downloading, installing, accessing, or using the Services — including creating an account — you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services and uninstall the app.

2. Eligibility & Age Requirement

You must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) to create an account or use the Services. The Services are not directed to children and must not be used by anyone under 13.

By using the Services you represent that:

• You meet the age requirement above
• You have legal capacity to enter into these Terms
• Information you provide is accurate and complete
• You will comply with all applicable laws, including real estate, consumer, and advertising laws in your area

3. User Accounts

Some features require an account. You agree to:

• Provide accurate registration information (name, email, phone, and other required fields)
• Keep your password confidential and not share your account
• Notify us promptly of unauthorized access at support@60yard.com
• Accept responsibility for activity under your account

We may refuse registration, require verification, or suspend accounts that appear fraudulent, abusive, or in violation of these Terms.

4. Account Deletion (Apple & Google Requirements)

If the Services allow account creation, you may request deletion of your account and associated personal data:

• In-app: use Profile / Settings → Delete Account (or equivalent) when available
• Web: submit a request at Account Deletion (required for Google Play users who cannot open the app)

Deletion removes your account and personal data we are not legally required to retain. Temporary deactivation alone is not treated as deletion. Details on timing and retained records are in our Privacy Policy.

5. Description of Services

60 Yard provides a technology platform for real estate discovery and related workflows, which may include:

• Browsing and searching property listings
• Creating, editing, and managing listings
• Submitting auction-related requests
• Shortlisting / saving properties
• Membership plans that unlock platform features
• Agent applications and KYC document submission
• Support / feedback submission

We are a platform provider. Unless we expressly state otherwise in writing, we are not a party to sale, lease, or auction contracts between users, and we do not provide legal, tax, financial, or investment advice.

6. License to Use the Mobile App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the 60 Yard mobile app on devices you own or control, solely for your personal or authorized business use in accordance with these Terms and the usage rules of Google Play or the Apple App Store (as applicable).

You may not copy, modify, distribute, reverse engineer, or create derivative works of the app except to the extent permitted by law.

7. Apple App Store & Google Play Acknowledgements

7.1 Third-party stores

If you download the app from the Apple App Store or Google Play, you also agree to the applicable store terms. Apple Inc., Google LLC, and their subsidiaries are not responsible for providing maintenance or support for the 60 Yard app, except as required under applicable store rules.

7.2 Apple-specific terms

To the extent you obtain the iOS app from Apple:

• These Terms are between you and 60 Yard only, not Apple
• Apple has no obligation to furnish maintenance or support services for the app
• In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple may refund the app purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation
• Apple is not responsible for addressing claims relating to the app or your possession/use of it, including product liability, legal/regulatory claims, or consumer protection claims
• In the event of a third-party claim that the app infringes intellectual property rights, 60 Yard (not Apple) is responsible for investigation, defense, settlement, and discharge as required by these Terms
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you regarding the iOS app

7.3 Google-specific terms

If you obtain the Android app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app’s content, maintenance, or support unless required by Google Play policies.

8. User-Generated Content

You may submit content such as property photos, descriptions, profile information, auction notes, feedback, and KYC documents ("User Content").

You retain ownership of your User Content. You grant 60 Yard a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content as needed to operate, improve, and promote the Services.

You are solely responsible for User Content you submit. You represent that you have all rights necessary to submit it and that it does not violate law or third-party rights.

We may remove or restrict User Content that violates these Terms, store policies, or applicable law, or that we reasonably believe is harmful, fraudulent, or misleading.

9. Property Listings & Accuracy

Listing information (price, availability, size, location, photos, legal status, and similar details) is provided by users or agents. We do not guarantee that any listing is accurate, complete, current, or suitable for your purpose.

You must independently verify property details, title, approvals, and legal status before making any purchase, rental, or investment decision.

10. Auctions & Bidding

Where auction features are available:

• You must follow the auction rules shown for each listing
• You should only participate if you are able and authorized to complete related obligations
• We may cancel, pause, or reverse auctions or submissions in case of error, fraud, technical failure, or policy violation
• Platform auction activity does not by itself complete a real estate transfer; separate contracts and legal formalities may apply

11. Agent Applications & KYC

If you apply to become an agent, you may be required to submit identity documents and financial/professional details (for example government ID, address proof, bank account information, and licenses). You agree that:

• All KYC information is true, current, and complete
• You are authorized to provide the documents
• We may review, approve, reject, or revoke agent status
• Providing false documents may result in immediate suspension and reporting where required by law

12. Payments, Memberships & Fees

Certain features may require payment of membership or other fees. Fees and plan details are shown before you confirm a purchase.

• Payments may be processed by third-party providers such as Razorpay
• You authorize the charge to the payment method you select
• Unless required by law or expressly stated by us, fees are non-refundable once processed
• We may change future pricing with notice in the app or on the website

If digital goods or subscriptions are offered through Apple In-App Purchase or Google Play Billing in the future, those purchases will also be subject to Apple’s or Google’s payment terms, refund rules, and subscription management settings.

Taxes may apply based on your location and applicable law.

13. Device Permissions

The mobile apps may request access to camera, photos/storage, and location to support listing photos, profile images, document uploads, and location-assisted listing tools. Permission is optional where the OS allows, but denying permission may limit related features. You can change permissions in your device settings at any time.

14. Prohibited Conduct

You agree not to:

• Violate any law or third-party right
• Post false, misleading, fraudulent, or infringing listings or documents
• Upload malware, scrape the Services without permission, or attempt unauthorized access
• Harass, threaten, or abuse other users or our staff
• Impersonate any person or misrepresent your affiliation or licenses
• Use the Services for money laundering, illegal property schemes, or spam
• Interfere with security, rate limits, or normal operation of the Services
• Bypass account deletion, payment, or access controls

15. Intellectual Property

The Services — including software, branding, logos, UI design, and original content (excluding User Content) — are owned by 60 Yard or its licensors. All rights not expressly granted are reserved.

16. Privacy

Our collection and use of personal data is described in the Privacy Policy, which forms part of your agreement to use the Services. By using the Services you consent to that processing as described, including processing needed for KYC, payments, and support.

17. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that listings, KYC checks, or payments will meet your expectations.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 60 YARD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100) IF NO SUCH PAYMENTS WERE MADE.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

19. Indemnity

You agree to defend, indemnify, and hold harmless 60 Yard and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Services, your real estate transactions, or your violation of these Terms or applicable law.

20. Suspension & Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate access if you violate these Terms, if required by law or store policy, or if we discontinue the Services. Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) will survive termination.

21. Governing Law & Changes

These Terms are governed by the laws applicable where 60 Yard primarily operates, without regard to conflict-of-law rules, unless mandatory consumer laws in your country provide otherwise.

We may update these Terms to reflect product, legal, or Apple/Google policy changes. We will post updates on this page and revise the "Last updated" date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Services and delete your account.

If any provision is found unenforceable, the remaining provisions remain in effect.
